1. Can I use my trademark before it is registered?
We do not recommend to start using it until it is duly registered before the Mexican Institute of Industrial Property (IMPI), the time frame is between 4 and 6 months starting from the date in which the trademark application was filed.
2. When will I have a registered trademark?
Once IMPI has conducted the corresponding exams, which will occur between 4 and 6 months after filing the trademark application.
3. What will happen if IMPI issues an oficial communication during the registration process?
It is important to answer any official communication within a period of 2 months and or an additional 2 more months, if the communication is not answered, the application will be abandoned by IMPI.
4. If a third party uses my registered trademark, what can I do?
We can draft a cease-and-desist letter, and in the event that the third party does not answer we can file an infraction.
5. When do I have to file the declaration of use for my registered trademark?
Every three years starting from the registration date.
6. What is the validity of my trademark?
10 years starting from the filing date and every 10 years subsequently.
7. How do I know that my trademark was filed?
We will send you the corresponding trademark application, which contains a trademark application number and IMPIS official seal.
8. Who can be the owner of a trademark application?
An individual, two individuals, a company or a combination, if there are two owners, they need to sign a document stating the coownership.
9. Can I file my trademark in more than 2 classes on the same application?
No, the trademark applications are for only one class.
10. Is my trademark registered internationally once I file it in Mexico?
No, the trademark registrations only protect the products or services that are covered per country.
